1. Introduction
Welcome to Halo Fresh (“we”, “our”, “us”). These Terms of Service (“Terms”) apply to all purchases made from our store, whether you are shopping within Australia or internationally. By placing an order, you agree to these Terms, our Privacy Policy, and our Returns & Refunds Policy.
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL) or equivalent consumer protection laws in your country of residence.
2. Products & Made-to-Order Policy
Most of our products are made to order. This means production starts once your order is placed. Please check all size charts, colours, and descriptions before purchase.
- Minor variations in colour or design may occur due to screen differences and printing processes.
- We may refuse an order if fraud is suspected or stock is unavailable.
3. Pricing & Payment
- All prices are shown in Australian Dollars (AUD) unless stated otherwise.
- Taxes (including GST) are applied according to your delivery address.
- For international customers, your country may charge import duties or taxes, which are your responsibility.
- Payment must be made in full before production begins.
4. Shipping & Delivery
Australia: Orders are shipped via trusted carriers (such as Australia Post, Sendle, or Printful’s partner couriers).
International: Delivery times vary depending on your location and customs processing.
- Shipping times provided are estimates only and not guaranteed.
- We are not responsible for delays caused by customs, postal services, or events outside our control (see Section 13).
- Tracking details will be emailed once your order is shipped.
5. Returns & Refunds
We follow our Returns & Refunds Policy in full compliance with the Australian Consumer Law:
- We do not accept returns for change of mind, wrong size ordered, or dislike of the product.
- If your product arrives faulty, damaged, or not as described, contact us within 7 days of receiving it with your order number, photos, and a description of the problem.
- If approved, we will replace the item or refund you (including shipping) at no extra cost.
6. Order Cancellations
- Orders can be cancelled within 12 hours of placement.
- Once production begins, cancellations are not possible.
7. Gift Cards & Promotions
- Gift cards are non-refundable and valid for 3 years from date of purchase (as per Australian law).
- Promotional codes cannot be exchanged for cash and must be applied at checkout.
8. International Orders
- By purchasing from us internationally, you agree to pay any applicable import duties or customs fees.
- We are not responsible for packages held or rejected by customs in your country.
9. Intellectual Property
All content on our store — including logos, designs, text, and images — is our property or used with permission.
You may not copy, reproduce, or use them without our written consent.
10. User Conduct
You must not:
- Use our site for illegal purposes.
- Attempt to gain unauthorised access to our systems.
- Misuse product images or content.
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential loss.
- Our total liability is limited to the purchase price of the product in question.
Nothing in these Terms limits your rights under the Australian Consumer Law.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Disputes will be handled in the courts of New South Wales, Australia, unless local laws require otherwise for overseas customers.
13. Force Majeure
We are not liable for delays or failures caused by events beyond our control, including natural disasters, strikes, pandemics, transport disruptions, or government actions.
